    Lawrence Segal and Andrew Shupe of Segal Law Group were featured in a cover story published by Los Angeles Lawyer Magazine in connection with a scholarly article that they authored on privacy rights under California law. The article was inspired by the firm's $3.9 million jury verdict in favor of four plaintiffs whose private telephone conversations were wiretapped and recorded by the defendants without the knowledge or consent of the firm's clients. McDougall v. Pellicano, et al, Los Angeles Superior Court Case No. BC 381720.

     

    Updates

     

    • Segal Law Group successfully located (and then levied upon) bank accounts of a judgment debtor who owed over $7 million to the firm's clients after he declared bankruptcy in an attempt to evade the judgment. Segal Law Group, in coordination with bankruptcy co-counsel, successfully obtained a Court ruling declaring that the multimillion-dollar judgment was not dischargeable in bankruptcy.

     

    • The firm also prevailed in Court on five separate pre-trial, case-ending motions in five separate lawsuits—two motions for summary judgment, two anti-SLAPP motions, and a motion to quash—successfully defeating claims for defamation, fraud, breach of fiduciary duty, and unauthorized use of likeness brought against the firm's clients. All five cases against the firm's clients were dismissed, based on strategic maneuvering and compelling, well-researched briefs.

    • On the plaintiff's side, the firm collected a trial court judgment for $207,000—100% of the amount awarded. The firm also continues to collect a monthly contribution toward a $3.9 million judgment for its client.

    • In the negotiated resolution arena, the firm recently negotiated a settlement of a contentious litigation between the firm's executive concierge client and the National Academy of Recording Artists and Sciences over the sale of Grammy tickets, negotiated the settlement of highly emotional partnership dissolution/buyout concerning a jointly owned business, and negotiated the settlement of a heated battle between commercial landlord and tenant, all resulting in settlements with favorable terms for the firm's clients.

     

    • In other developments, the firm prevailed before the Court of Appeal and obtained a partial reversal and remand of an erroneous court judgment. Tradewind Consulting LLC v. Wildcat Distributors, Inc., et al, California Court of Appeal (Second Appellate District) Case No. B250835.

    Trial Victory in Case involving Use of Audrey Hepburn's Name & Likeness

    After a four-week trial regarding the use of Audrey Hepburn’s name and likeness without the collective permission of her heirs, Segal Law Group (representing Sean Hepburn Ferrer, one of Hepburn’s sons) obtained a victory, resulting in a Court judgment against a corporation endeavoring to exploit Audrey Hepburn intellectual property rights without her son's permission. Ms. Hepburn was an Academy Award winning actress who is perhaps best known for her work in “Breakfast at Tiffany’s,” but whose later life involved tireless work for children’s causes throughout the world. By preserving the valuable intellectual property rights in the name of her heirs, Segal Law Group prevented dilution of the value of her name and likeness which, even today, more than 25 years after her death, is worth millions of dollars.

     

    Other Updates

     

    • In two other matters, Segal Law Group’s tenacity resulted in the Court’s dismissal of two separate lawsuits brought against the firm's clients. Both cases were dismissed by Court order and Segal Law Group’s clients paid no money to the opposing party, successfully defeating claims where the Plaintiffs were seeking $10 million and $1.5 million, respectively.

    • After prevailing on an anti-SLAPP motion that resulted in the striking of the entire Complaint filed against the firm’s client, Segal Law Group was successfully awarded $101,000 in attorney's fees.

    • On the eve of two separate trials where Segal Law Group represented the Defendants, in both instances, the Plaintiffs simply gave up and dismissed the suits rather than go to trial and face the defenses that Segal Law Group had developed.

    Lawrence Segal

    With over 30 years of civil litigation and trial experience, Lawrence Segal founded the firm with a concentration on business, entertainment, and real estate disputes. He also provides general counsel services and strategic advice to small businesses and entrepreneurs who are either contemplating litigation or attempting to avoid it. He conducts contract and agreement review in appropriate circumstances.

    Capable of representing either plaintiffs or defendants in state or federal court, Lawrence successfully defended MCA Television in a four-week federal court jury trial, defeating the plaintiffs' $15 million claim and obtaining a defense verdict that was upheld on appeal. On the plaintiff's side, he obtained a $2.7 million settlement for the son of a prominent rock musician who was deprived of inclusion in the division of his late father's estate and copyrights. Lawrence also obtained a $3.9 million jury invasion of privacy verdict on behalf of plaintiffs.

     

    A substantial number of cases have involved business and partnership-type disputes between partners, shareholders or members in companies where relations have soured, but the stakes remain high. Lawrence has also successfully resolved breach of contract and false light claims against Michael Jackson and Oprah Winfrey, but more commonly represents parties in less high-profile matters where the outcome remains just as important to those involved.

    Andrew Shupe

    Since graduating from the UCLA School of Law, Andrew Shupe has worked as an associate attorney for boutique law firms in Los Angeles specializing in business litigation and intellectual property matters. Andrew joined the firm in 2009. He has practiced before California courts, federal courts in California, Illinois, and Texas, the Trademark Trial and Appeal Board (TTAB), and the International Trade Commission (ITC).

    Andrew's experience includes general business litigation matters, partnership disputes, entertainment law, copyright and trademark litigation, trademark applications and inter partes proceedings before the TTAB, and ITC investigation proceedings.

    Tabitha Chan

    Tabitha Chan has superior organizational skills and specializes in preparing cases for depositions and trial.

    For several years prior to joining the firm, Tabitha was an intellectual property and business litigation paralegal at a large national/international law firm. She has assisted in trials in Superior Court, Federal Court, and before the International Trade Commission in Washington D.C.
